YUMA COUNTY BOARD OF SUPERVISORS MINUTES: May 5, 2026 Regular Session The Yuma County Board of Supervisors met in a Regular Session on May 5, 2003. The meeting was held at 198 South Main Street, Yuma, Arizona. At 8:39 a.m., the Chairman called the meeting to order. Supervisors present: Lenore Loroa Stuart, Lucy Shipp, Robert J. McLendon, Casey Prochaska, and Marco A. Reyes. Staff present: Interim County Administrator Harold Aldrich, Interim Clerk of the Board Sue Stallworth, Chief Civil Deputy County Attorney Jon Smith, and Deputy County Attorney Ed Feheley. Item B: Authorize an Executive Session to be held at 8:30 a.m., pursuant to Arizona Revised Statute 38-431.03, and recess Regular Session and convene Executive Session. Supervisor Shipp moved and Supervisor Reyes seconded to authorize an Executive Session as presented in Item B. The motion carried. Chairman Stuart recessed the Regular Session at 8:40 a.m. At 9:10 a.m., the Regular Session was reconvened and immediately recessed. At 9:10 a.m., the Chairman reconvened the Regular Session. Supervisor Prochaska led the Pledge of Allegiance. Item E: CALL TO THE PUBLIC George Broucek, 10198 South Del Rico, Yuma, inquired about the status of the Landscape Renovation Project at Mesa del Sol. The Supervisors requested that Public Works staff provide an update at the June 2, 2026 meeting. James Tilson, 10327 South Mountain Drive, Yuma, inquired about the stoppage of County maintenance on the roads east of Avenue 14-1/2E, in Mountain View Estates, and questioned legal counsel's interpretation of the related statutes. The Supervisors requested legal staff to consider Mr. Tilson's questions and respond as appropriate. Item F: PRESENTATION: No. 1: Adopt and authorize Chairman to sign Resolution No. 03-30 proclaiming May 5 through May 11, 2026 as National Public Service Recognition Week in Yuma County. Supervisor Shipp moved and Supervisor Prochaska seconded to adopt and authorize the Chairman to sign Resolution No. 03-30 as presented. The motion carried 5-0 by a roll call vote: Shipp-aye; Prochaska-aye; Reyes-aye; McLendon-aye; Stuart-aye. CONSENT AGENDA: Supervisor Shipp moved and Supervisor Prochaska seconded to approve Consent Items Nos. 1 through 6, with the exception of No. 4. The motion carried.The approved items are: No. 1: County Attorney: No. 1a: Revise the payroll percentage in the Arizona Department of Public Safety Victim Assistance Grant No. 2001-959 for the Victim Witness Advocate II from Fund Nos. 55% Y211-031 and 45% 2Y100-030 to 100% Fund No. Y211-031, 05-11-03. No. 1b: Chairman and the County Attorney to sign the Arizona Department of Public Safety/Victims of Crime Act/Victim Assistance Grant No. 2003-054 in the amount of $119,990, including matching funds in the amount of $29,998 in the General Funds. No. 2: Financial Services: Approve the Accounts Payable & Payroll Demands disbursed in the amount of $6,216,952.77 for the period of April 8, 2026 through April 22, 2003. No. 6: Assessor's Office: Approve Tax Roll Corrections pursuant to Arizona Revised Statutes, Title 42, Chapter 16, Article VI. (A full listing of Tax Roll Corrections is available for public review at the office of the Board of Supervisors.) DISCUSSION AGENDA: No. 4: Development Services: Adopt and authorize the Chairman to sign Resolution No. 03-31, authorizing the submission of grant applications to the Water Infrastructure Finance Authority for Project Technical Assistance funds for the following projects: Wall Lane Water System; Dateland Water System; and the B/C Colonia Sewer Project; and authorize the set-a-side of Community Development Block Grant funds to be used as matching contributions. Supervisor Reyes moved and Supervisor McLendon seconded to adopt and authorize the Chairman to sign Resolution 03-31 as presented. The motion carried. No. 7: Sheriff's Department: Grant the budget authority and spending authority in Fund No. Y306-390 for Fiscal Year 2002-03 in the amount of $102,028 to reflect an award from the U.S. Department of Justice, Office of Community Oriented Policing Services for the COPS MORE 02 Program. Supervisor McLendon moved and Supervisor Reyes seconded to authorize acceptance of the award and to consider a request for action to authorize the actual purchase at the next Board meeting . The motion carried. No. 8: County Attorney's Office: As discussed in Executive Session, action regarding the leasing of a 181 acre parcel, including 172 acres located at the Yuma County International Airport. Supervisor Shipp moved and Supervisor McLendon seconded that Yuma County retain the negotiating authority with the Department of the Navy for leasing of the 181 acre parcel, that includes the 172 acres located at the Yuma International Airport. The motion carried 5-0 by a roll call vote: Shipp-aye; McLendon-aye; Reyes-aye; Prochaska-aye; Stuart-aye. No. 9: Human Resources: Action to add Mexican medical services to the Yuma County Employee Benefit Trust Health Plan and amend the plan document language regarding morbid obesity surgery. Supervisor Prochaska moved and Supervisor Reyes seconded to add Mexican medical service providers to the Yuma County Health Plan as recommended. The motion carried 3-2 by a roll call vote: Prochaska-aye; Reyes-aye; McLendon-no; Shipp-aye; Stuart-no. Supervisor McLendon moved and Supervisor Shipp seconded to approve the amended plan document language regarding morbid obesity surgery as recommended. The motion carried 5-0 by a roll call vote: McLendon-aye; Shipp-aye; Reyes-aye; Prochaska-aye; Stuart-aye. No. 10: Financial Services: No. 10a: Discussion regarding the Arbitrage Rebate Liability Certificate of Participation1998 - Health Building. No official action was taken. No. 10b: Authorize the transfer of the Debt Service Reserve balance at March 31, 2026 in the amount of $3,008,364.34, and any applicable residual interest earnings, from the Capital Improvement Fund to the Certificate of Participation Debt Service Fund, to recognize the classification of the required "debt service reserves" as a Designations of Fund Balance for Debt Service rather than a Capital Project Appropriation. Supervisor Shipp moved and Supervisor Reyes seconded to authorize the transfer as recommended by staff in Item No. 10b. Motion carried. No. 10c: Authorize the reclassification from "residual equity transfer" to "operating transfer" and establish budget authority for the transfer of $8,935,983 from the Highway Users Road Fund to the Department of Development Services HURF. . Supervisor McLendon moved and Supervisor Prochaska seconded to approve the requested board action as presented by staff. The motion carried. No. 11: Development Services: Action to award the bid for the Avenue 14E Low Flow Crossing Improvement Project, and authorize the County Engineer to sign the construction contract. Supervisor Shipp moved and Supervisor Prochaska seconded to award the bid to J. Banicki Construction Company in the amount of $457,124.29 and authorize the County Engineer to sign the construction contract. The motion carried. No. 12: Board of Supervisors: No. 12a: Authorize the Yuma County Fair, Inc., to hold race days as awarded to Yuma County for the Fiscal Years 2002-03 and 2003-04 at Yavapai Downs in Prescott Valley, Arizona; and authorize the Chairman to sign a letter to the Arizona Racing Commission stating same. Supervisor Shipp moved and Supervisor Prochaska seconded to approve Item No. 12a as presented. The motion carried. No. 12b: Action regarding Yuma County's 2003 Legislative Agenda and related issues. No official action was taken. No. 12c: Events Calendar: Board members will report on events attended and/or to be attended on behalf of the Board of Supervisors, and update the schedule for future Board of Supervisors' Meetings, as appropriate. No official action was taken. At 10:17a.m., the Chairman convened the Board of Supervisors in Joint Session with the Boards of Directors of all Improvement & Special Districts, the Free Library District, and the Jail District No. 13: Approve the April 21, 2026 Regular Session and Free Library District and Jail District minutes. Supervisor Shipp moved and Supervisor Reyes seconded to approve the minutes as presented. Motion carried. At 10:18 a.m., the Chairman adjourned as the Boards of Directors of all Improvement & Special Districts, the Free Library District, and the Jail District continued the Board of Supervisors in Regular Session, then recessed at 10:19 a.m. until 1:30 p.m. At 1:32 p.m., the Chairman reconvened the Regular Session of the Yuma County Board of Supervisors. Supervisors present: Lenore Loroa Stuart, Lucy Shipp, Robert J. McLendon, Casey Prochaska, and Marco A. Reyes. PUBLIC HEARINGS: Note: Full legal descriptions of property sites for all Rezoning Cases and/or Commission Initiatives are available for public review at the Yuma County Board of Supervisors' Office. No. 14: Special Use Case No. 03-03: Request by Roxanne B. and David C. Staats for a Special Use Permit per Section 1108.15 of the Yuma County Zoning Ordinance to allow a recreational vehicle as a permanent second dwelling unit on a 51,400 square foot minimum parcel zoned Low Density Residential - 40,000 Square Foot Minimum Parcel Size on Assessor's Parcel No.103-49-021, located at 11637 Sunburst Avenue, Yuma Arizona. The applicant, David Staats, 11637 Sunburst Avenue, Yuma, was present. No one from the public spoke in favor or in opposition to the request. Supervisor Shipp moved and Mr. Reyes seconded to approve Special Use Case No. 03-03 as requested and subject to Conditions Nos. 1 through 7 as recommended by the Planning and Zoning Commission. The motion carried. No. 15: Special Use Case No. 03-04: Request by George and Teresa Davis for a Special Use Permit per Section 1108.15 of the Yuma County Zoning Ordinance to allow a 1,500 square foot site-built home as a second dwelling unit on a 10.0 acre ( parcel zoned Rural Area - 10 Acre Minimum Parcel Size on Assessor's Parcel No. 107-18-007L, located at 4244 South Avenue 18-3/4E. The applicants, George & Theresa Davis, 4535 South Avenue 18 3/4E, Yuma, were present and responded to questions. Three people spoke in opposition and no one spoke in favor during the public hearing. Supervisor Shipp moved and Supervisor Prochaska seconded that with the understanding that the actions this Board takes do not set precedents, as it considers each special use request on its own merits, the Board approves Special Use Permit No. 03-04 as requested with Conditions Nos. 1 through 6, with Condition No. 6 to include the phrase "or as per code requirements." The motion carried 5-0 by a roll call vote: Shipp-aye; Prochaska-aye; McLendon-aye; Reyes-aye; Stuart-aye. No. 16: Special Use Case No. 03-06: Request by Javier D. and Armida R. Coronado for a Special Use Permit per Section 607.03B of the Yuma County Zoning Ordinance to allow the use of a 7,200 square foot building for daily community activities, retreats, Bible study, special conferences, music lessons for children and adults, English lessons, Karate lessons, computer lessons, and family reunions on a 52,633 square foot parcel zoned Manufactured Home Subdivision - 20,000 Square Foot Minimum Parcel Size , on Assessor's Parcel No. 113-15-014B, located at 727 Clifford Way. Agent for the applicant, Armida Coronado, 2550 West County 14th Street, Yuma, was present and responded to questions. During the public hearing, seven people spoke in opposition and four spoke in support of the request. Supervisor Reyes moved and Supervisor McLendon seconded to approve Special Use Case No. 03-06, as requested, subject to Conditions Nos. 1 through 9, with modification to change all 11:00 p.m. times to 10:00 p.m., to modify Condition No. 7 to restrict off site parking; and to add a new Condition No. 10 that the permit would be subject to review and renewal after two years. The motion failed 1-4 by a roll call vote: Reyes-aye; McLendon-no; Prochaska-no; Shipp-no; Stuart-no. At 3:01 p.m., the Chairman recessed the Regular Session and then reconvened at 3:12 p.m. No. 17: Rezoning Case No. 02-40: Request by Greg Brown, Agent for Charles and Shirley Bush, to rezone an approximate 4.62 acre parcel from Rural Area-20 Acre Minimum Parcel (R-1-40)on part of Assessor's Parcel No. 107-63-041, located south of Snipe Road immediately after the Red Cloud Mine Road intersection at North Martinez Lake. The applicants' agent, Greg Brown, 821 Camelot Parkway, El Cajon, California, was present. There were no public comments in favor or in opposition to the request.Supervisor Prochaska moved and Supervisor McLendon seconded to approve Rezoning Case No. 02-40 as requested, with Conditions Nos. 1 through 7, and adding Condition No. 8 as recommended by the planning staff. The motion carried. The approved conditions are: 1) All requirements of the Yuma County Zoning Ordinance shall be met; 2) All requirements of the Environmental Health laws, including but not exclusively, Arizona Revised Statutes, Titles 36 and 49 and Arizona Administrative Code, Rules 9 and 18, shall be met; 3) If legal access is not established for the parcels created from any future splits, then the lack of legal access, and/or if applicable, the lack of physical access for emergency vehicles, shall be noted on the appropriate deeds in accordance with ARS 11-809; 4) All requirements of the Yuma County Comprehensive Building Safety Code be met in future construction, alterations or remodeling of buildings; 5) A Flood Plain disclosure statement shall be recorded within 60 days of approval by the Board of Supervisors; 6) An infrastructure disclosure statement shall be recorded within 60 days of approval by the Board of Supervisors. Yuma County will be held harmless and not obligated to make improvements to the roadway infrastructure supporting these properties. 7) No more than one access point will be permitted onto Red Cloud Mine Road; and 8)Approval of this request is based on the site plan submitted by the applicant. Any substantial change will require this request to be reheard. At 3:19 p.m., the Chairman recessed the Regular Session and then reconvened at 3:21 p.m. No. 18: Rezoning Case No. 03-01: Request by Leticia Moreira, Agent for Jeffery C. and Pamela C. Bell to rezone a 10.0 acre parcel from Rural Area-10 Acre Minimum Parcel Size to Suburban Site Built - 2 Acre Minimum Parcel on Assessor's Parcel No. 104-23-016, located at Avenue 2-3/4E and County 15-3/4 Street. Agent for the applicants, Leticia Moreira, 2847 East Co. 15 ? Street, Yuma, was present and responded to questions regarding access to the property. There were no public comments in favor or in opposition to the request. Supervisor Shipp moved and Supervisor Prochaska seconded to continue Rezoning Case No. 03-01 . The motion carried 4-1 by a roll call vote: Shipp-aye; Prochaska-aye; Reyes-No; McLendon-aye; Stuart-aye. No. 19: Rezoning Case No. 02-42: Request by Barry Olsen, Agent for Colo-Gila Investments, L.L.C. to rezone 10.0 acres from Recreational Vehicle Subdivision to Planned Development to Low Density Residential - 40,000 Square Foot Minimum Parcel Size on Assessor's Parcel No. 108-26-007C, approximately located at the northeast corner of Highway 95 and Avenue 6E. Agent for the applicants, Barry Olsen, 101 East 2nd Street, Yuma, presented additional information on the request, which included photographs and a covenant agreement that was distributed to the homeowners of El Prado Estates. There were no public comments in favor or in opposition to the request. Supervisor Prochaska moved and Supervisor Reyes seconded to approve Rezoning Case No. 02-42, subject to conditions 1 through 5, deleting conditions 6, 8, 9, 10 and 11, keeping No. 7, and amending Condition No. 12 to read the sign will be located 150 feet off the south boundary on the east boundary, not to exceed 300 square feet and 35 feet in height, and may be illuminated as per the Yuma County Dark Sky Ordinance with appropriate aircraft warning lights; and adding a new condition that the units on the southern boundary will not exceed eight feet in height and that the south perimeter wall shall be constructed between six to eight feet; adding a new condition to require the applicant to execute and record the covenant agreement with the El Prado homeowners as presented this date, and including Notes for the Record D, E, and F. The motion carried 5-0 by a roll call vote: Prochaska-aye; Reyes-aye; McLendon-aye; Shipp-aye; Stuart-aye. The approved conditions are: 1) All requirements of the Yuma County Zoning Ordinance shall be met; 2) All requirements of the Environmental Health laws, including but not exclusively, Arizona Revised Statutes, Titles 36 and 49 and Arizona Administrative Code, Rules 9 and 18, shall be met; 3) All requirements of the Yuma County Comprehensive Building Safety Code be met in future construction, alterations or remodeling of buildings; 4) An agricultural disclosure statement shall be recorded within 60 days of approval by the Board of Supervisors; 5) An avigational disclosure statement shall be recorded within 60 days of approval by the Board of Supervisors; 6) The area designated as office space shall be allowed one caretaker's quarters; 7) A sign may be located 150 feet off the south boundary on the east boundary, not to exceed 300 square feet and 35 feet in height, and may be illuminated as per the Yuma County Dark Sky Ordinance with appropriate aircraft warning lights; 8) The units on the southern boundary will not exceed eight feet in height and the south perimeter wall shall be constructed between six to eight feet; 9) Require the execution and recordation of the covenant agreement with the El Prado Estates homeowners as presented to the Board of Supervisors on May 5, 2003. Notes for the Record: D) ARS28-8481 requires that Yuma County report to the Arizona Attorney General's office any action of the Board of Supervisors other than denial in this request. This applies to any zoning request in the 65 dB or higher noise zone or in the Accident Potential Zone. The Attorney General may institute a civil action in the name of the State of Arizona in Yuma County, if the Attorney General has probable cause to believe that the approved change violates either ARS28-8481 or ARS28-8482. The Board of Supervisors has a specific finding that, by this action, the purpose of military airport compatibility is preserved. E) Land uses in any zoning district in the 65dB or higher noise zone or in the accident potential zones are subject to compliance with the Yuma County Airport District Land Use Matrix in accordance with ARS28-8481 AND ARS28-8482, in order to ensure that the purpose of military airport compatibility is preserved. Land uses within a noise zone or accident potential zone are subject to the Land Use Standards and Development Criteria as shown in the Yuma County Airport District Land Use Matrix, a copy of which may be obtained from the Department of Development Services; F) In accordance with ARS28-8481 and ARS28-8482, land uses must ensure that the purpose of military airport compatibility is preserved. If a land use is not listed in the Yuma County Land Use Matrix, it is presumed to be incompatible in any zoning district in the 65dB or higher noise zone or in the accident potential zones and a variance shall be required. The Yuma County Airport Board of Adjustment may review an individual use to determine if it is compatible and consistent with the high noise or accident potential of the military airport. The final determination of compliance requires a hearing by the Airport Board of Adjustment through a variance process prior to the issuance of any building permits or the use being established. No. 20: Rezoning Case No. 02-43: Request by Rosemarie Valenzuela, Agent for Connie Gonzales, Santos Castaneda, Fidelia Ayala, Eddie Valenzuela and Albert Valenzuela to rezone a 36.54 acre parcel from Rural Area - 20 Acre Minimum Parcel Size to Rural Area - 5 Acre Minimum Parcel Size on Assessor's Parcel No. 107-16-017, located south of County 3rd Street and approximately 1,200 feet of Laguna Dam Road. The applicant, Rosemarie Valenzuela, was present. Wade Noble, 1405 West 16th Street, Yuma, spoke on behalf of the North Gila Irrigation District in support to the request. Supervisor McLendon moved and Supervisor Prochaska seconded to approve Rezoning Case No. 02-43 as requested, with conditions 1 through 7 as recommended. The motion carried. The approved conditions are: 1) All requirements of the Yuma County Zoning Ordinance shall be met; 2) All requirements of the Environmental Health laws, including but not exclusively, Arizona Revised Statutes, Titles 36 and 49 and Arizona Administrative Code, Rules 9 and 18, shall be met; 3) All requirements of the Yuma County Comprehensive Building Safety Code be met in construction, alterations or remodeling of buildings; 4) An agricultural disclosure statement shall be recorded within 60 days of approval by the Board of Supervisors; 5) An infrastructure disclosure statement shall be recorded within 60 days of approval by the Board of Supervisors. Yuma County will be held harmless and not obligated to make improvements to the roadway infrastructure supporting these properties; 6) The approval of this rezoning request is based on the survey submitted by the applicant. Any change from this survey will require the rezoning request to be reheard; and 7) All required improvements including the filing and approval of a tentative plat, final plat and posting of necessary assurances, all of which shall be attached to this property as a subdivision of parcel 107-16-017 into six or more lots within three years of approval or the rezoning will be reviewed to revert to RA-20 in accordance with Section 405.05 of the Zoning Ordinance and A.R.S. 11-832.No. 21: Minor Amendment Case No. 2003-MA-03: Request by Jose and Francisca Galvez for a minor amendment to the Yuma County 2010 Comprehensive Plan for 5.0 acres from Agricultural/Rural Residential to Suburban Density Residential on Assessor's Parcel No. 101-23-001, located at the southeast corner of County 17-3/4 Street and Avenue 3-1/2E. The applicant was not present or represented by an agent. There were no public comments in favor or in opposition to the request. Supervisor Shipp moved and Supervisor Reyes seconded to deny Minor Amendment Case No. 2003-MA-03. The motion carried. At 4:46 p.m., the Chairman recessed the Regular Session and then reconvened at 4:56 p.m. DISCUSSION AGENDA: No. 22: Board of Supervisors: Presentation regarding Voluntary Payments in Lieu of Taxes for the proposed Wellton-Mohawk Generating Facility/Natural Gas-Fired Generating Plant. Supervisor Prochaska declared a conflict of interest on Items No. 22 and No. 23 and was excused from the meeting at 4:57 p.m. The Board received the presentation from Wade Noble, 1405 West 16th Street, Yuma. Mr. Noble advised that a proposal would be submitted by May 9, 2026 on voluntary payments in lieu of taxes for this project for consideration and negotiation as desired by Yuma County. County Assessor Joe Wehrle provided information on taxable property and responded to questions. The Board's discussion indicated a consensus to direct County staff to receive the proposal and conduct a review process as appropriate before sending on to the Board of Supervisors for consideration and action. There was no official action. DEVELOPMENT SERVICES - PUBLIC HEARING ITEM: No. 23: Special Use Case No. 03-02: Request by the Wellton-Mohawk Irrigation and Drainage District; Yuma County Water Users' Association; and the Dome Valley Energy Partners, L.L.C. for a Special Use Permit per Section 601.03.L of the Yuma County Zoning Ordinance to allow the construction of a Natural Gas Fired Generating Plant on a 118.81 acre portion on parts of Assessor's Parcels Nos. 204-35-005, 204-17-016, 204-17-001, 204-17-002C, and 204-18-003, zoned Rural Area - 40 Acre Minimum Parcel, located at Avenue 22E between Old Highway 80 and Interstate 8. The applicants were represented by Bruce Wertz, Prime South, Columbia, South Carolina, who described the project, its location, and responded to questions. During the public hearing four people spoke in opposition to the request, no one spoke in favor. Don Pope, General Manager, Yuma County Water Users Association, spoke on behalf of the project. Supervisor Shipp moved and Supervisor Reyes seconded to continue Special Use Case No. 03-02 to the meeting of June 2, 2003. The motion carried. Supervisor Shipp moved and Supervisor Reyes seconded to adjourn until May 19, 2003. The motion carried. At 6:07 p.m., the Chairman adjourned the meeting.
